5A.2 - International Suppliers and Fulfillment Partners
HARD'N'HEAVY LLC operates through an international network of independent manufacturers, brands, distributors, suppliers, and logistics service providers.
Products may be sourced, manufactured, stored, processed, and dispatched from various countries, including but not limited to countries in Asia, Europe, North America, and other regions.
We do not necessarily maintain physical possession of products before they are dispatched to customers.
Depending on the product and supplier, orders may be fulfilled directly by an independent manufacturer, brand, distributor, supplier, or third-party fulfillment facility.
These independent service providers may perform functions including manufacturing, sourcing, inventory storage, order preparation, packaging, transportation, returns processing, and other logistics activities.
Unless expressly identified otherwise, these providers do not enter into the retail purchase agreement with the customer and do not replace HARD'N'HEAVY LLC as the seller of record.
The physical location of a supplier, manufacturer, inventory facility, or shipping provider may differ from HARD'N'HEAVY LLC's state of organization or business mailing address.
5A.3 - Order Placement and Acceptance
By placing an order, the customer submits an offer to purchase the selected products at the prices and on the terms displayed during checkout.
Submission of an order and successful payment authorization do not necessarily constitute final acceptance of that order.

The physical location from which a product is dispatched does not, by itself, determine when or where legal title transfers to the customer.
Payment authorization, order placement, issuance of a tracking number, or physical dispatch does not independently establish transfer of legal ownership unless the applicable law and transaction terms provide for that result.
Nothing in this section is intended to transfer legal title before the goods have been properly identified to the customer's order or before such transfer is legally effective.
The transfer of legal title is separate from the allocation of delivery risk and does not limit the customer's statutory rights or remedies.
5A.5 - Risk of Loss and Delivery Responsibility
For consumer purchases, HARD'N'HEAVY LLC remains responsible for the risk of accidental loss or damage during transportation until the products are delivered to the customer or a person designated by the customer to receive them, unless applicable law provides otherwise.
Where a customer independently engages a shipping carrier that was not offered or designated by HARD'N'HEAVY LLC, the risk of loss may pass when the goods are handed over to that carrier, to the extent permitted by applicable law.
Any transfer of legal title before delivery does not relieve HARD'N'HEAVY LLC of its delivery obligations or mandatory responsibilities for lost or damaged shipments.
